  7. In the event of a promotion, the Store informs Customers of the lowest price of the Product over the preceding 30 days. If the Product has been on sale for less than 30 days, the pre-promotion price is the lowest price recorded since the Product was introduced to the Store. 10. Entrepreneurs with Consumer Rights must indicate, at the time of placing the order, that the purchase is not of a professional nature for them.
  11. After placing an order, the Customer receives an order confirmation at the e-mail address provided in the Order Form.

  16. The Customer will receive a notification that the order has been accepted for processing; this constitutes the Seller's declaration of acceptance of the offer. The Sales Agreement is concluded the moment the Customer receives it.

VI. COMPLAINTS

  1. The Seller is liable for the Product’s non-conformity with the Contract. The provisions of the Act of 23 April 1964 – Civil Code (consolidated text: Journal of Laws of 2023, item 1610, as amended) regarding statutory warranty for defects do not apply to contracts obliging the transfer of ownership of Goods to a Consumer, including in particular sales contracts, supply contracts, and contracts for specific work resulting in Goods.
  2. The Seller is liable for any lack of conformity of the Product with the Contract that exists at the time of delivery and becomes apparent within two (2) years from that time, unless a longer period of usability has been specified by the Seller, its legal predecessors, or persons acting on their behalf. It is presumed that any lack of conformity of the Product with the Contract that becomes apparent within two (2) years of delivery existed at the time of delivery, unless proven otherwise or unless such presumption is incompatible with the specific nature of the Product or the nature of the lack of conformity.
  3. If the Product is not in conformity with the Contract, the Consumer may request its repair or replacement. The Seller may carry out a replacement when the Consumer requests a repair, or a repair when the Consumer requests a replacement, if bringing the Product into conformity with the Contract in the manner chosen by the Consumer is impossible or would entail excessive costs for the Seller. If repair and replacement are impossible or would entail excessive costs for the Seller, the Seller may refuse to bring the Product into conformity with the Contract.
  4. The Seller shall carry out the repair or replacement within a reasonable time after the Consumer has informed the Seller of the lack of conformity with the Contract, and without undue inconvenience to the Consumer, taking into account the nature of the Product and the purpose for which the Consumer acquired it. The costs of repair or replacement, including in particular the costs of postage, carriage, labour, and materials, shall be borne by the Seller. To this end, the Consumer shall make the Product subject to repair or replacement available to the Seller. The Seller shall collect the Product from the Consumer at its own expense. If the Product was installed prior to the lack of conformity becoming apparent, the Seller shall dismantle the Product and reinstall it—or arrange for these actions to be performed—at its own expense.
  5. If the Product is not in conformity with the Contract, the Consumer may submit a statement regarding a price reduction or withdrawal from the Contract when:
  6. a) the Seller has refused to bring the Product into conformity with the Contract;
  7. b) the Seller has failed to bring the Product into conformity with the Contract;
  8. c) the lack of conformity persists despite the Seller’s attempt to bring the Product into conformity with the Contract;
  9. d) the lack of conformity is of such a serious nature as to justify a price reduction or withdrawal from the Contract without first requesting repair or replacement;
  10. e) it is clear from the Seller’s statement or the circumstances that the Seller will not bring the Product into conformity with the Contract within a reasonable time or without undue inconvenience to the Consumer.
  11. The reduced price must be proportionate to the price under the Contract in the same ratio as the value of the Product not in conformity with the Contract bears to the value of a product in conformity with the Contract. The Seller shall refund to the Consumer the amounts due as a result of the exercise of the right to a price reduction without undue delay and no later than fourteen (14) days from the date of receipt of the Consumer’s statement regarding the price reduction.
  12. The Consumer may not withdraw from the Contract if the lack of conformity of the Product with the Contract is minor. The lack of conformity of the Product with the Contract is presumed to be significant.
  13. In the event of withdrawal from the Contract, the Consumer shall promptly return the Product to the Seller at the Seller's expense. The Seller shall refund the price to the Consumer promptly, and no later than fourteen (14) days from the date of receipt of the Product or proof of its dispatch, using the same payment method employed by the Consumer, unless the Consumer has expressly agreed to a different method of refund that entails no costs for them.
  14. Complaints regarding Products may be submitted:
  15. a) in writing, to the Seller’s registered office address: Harcerska 8/1, 57-320 Polanica Zdrój;
  16. b) via e-mail, to the address: cjbrzozowski@outlook.com.
  17. The complaint should include:
  18. a) details of the person submitting the complaint (full name, correspondence address, e-mail address, and contact telephone number);
  19. b) an indication of the reason for the complaint and the nature of the claim;
  20. c) the Order number appearing in the Order acceptance confirmation;
  21. d) the original or a copy of the proof of purchase (e.g., a receipt or invoice)—while this may facilitate the submission of the complaint, it is not mandatory for doing so.
  22. The above provisions do not preclude the Seller from granting a warranty for the purchased Products, as provided for in separate warranty terms and conditions.

VII. RIGHT OF WITHDRAWAL

  1. In accordance with the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2020, item 287, as amended), the Consumer may withdraw from the Contract concerning Products purchased in the Store without stating a reason by submitting an appropriate written statement within fourteen (14) days, calculated from the day of delivery of the Goods (i.e., from the day the Consumer takes possession of the Goods). This time limit is deemed met if the Consumer sends the statement before the period expires.
  2. The Consumer may withdraw from the Contract by submitting a statement of withdrawal from the Contract to the Seller. A template for the statement constitutes Appendix No. 1 to these Terms and Conditions.
  3. The statement of withdrawal from the Contract should be sent to the address: Harcerska 8/1, 57-320 Polanica Zdrój.
  4. The Consumer shall return the Goods to the Seller within fourteen (14) days from the date of withdrawal from the Contract. Sending the Goods back before the expiry of this period is sufficient to meet the deadline.
  5. The Consumer bears only the direct costs of returning the Goods.
  6. The Goods must be returned to the Seller's address: ul. Harcerska 8/1, 57-320 Polanica Zdrój.
  7. Within fourteen (14) days of the date of receipt of the notice of withdrawal from the Contract, the Seller shall refund to the Consumer all payments made by the Consumer, including the cost of delivery of the Goods; however, the refund shall not be made until the Goods have been received back or the Consumer has provided proof of their return.
  8. If the Consumer has chosen a method of delivery other than the cheapest method of delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred.
  9. The Seller shall make the refund using the same payment method as that used by the Consumer.
  10. The Consumer is liable for any diminution in the value of the Product resulting from the use of the Product in a manner going beyond what is necessary to establish the nature, characteristics, and functioning of the Product.
  11. The Consumer does not have the right to withdraw from the Sales Contract in the case of an agreement:
  12. a) where the subject matter of the performance is a non-prefabricated Good, manufactured according to the Consumer's specifications or intended to meet the Consumer's individualized needs;
  13. b) where the subject matter of the performance is a Good that is liable to deteriorate rapidly or has a short shelf life;
  14. c) where the subject of the performance is alcoholic beverages, the price of which was agreed upon at the conclusion of the Contract, the delivery of which can only take place after 30 days, and the value of which depends on market fluctuations over which the Seller has no control;
  15. d) where the subject of the performance is Goods supplied in sealed packaging which cannot be returned after the packaging has been opened due to health protection or hygiene reasons, if the packaging was opened after delivery;
  16. e) where the subject of the performance is Goods which, due to their nature, become inseparably mixed with other goods after delivery;
  17. f) where the subject matter of the performance is audio or visual recordings or computer software supplied in a sealed package, if the package has been opened after delivery;
  18. g) for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts;
  19. h) where the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the expiry of the deadline for withdrawal from the Contract;
  20. i) for the supply of Goods with digital elements, digital services, or digital content not supplied on a tangible medium, for which the Consumer is obliged to pay a price, if the Seller has commenced performance with the express and prior consent of the Consumer—who was informed before the commencement of performance that, upon performance by the Seller, they would lose the right to withdraw from the Contract and acknowledged this fact—and the Seller has provided confirmation to the Consumer;
  21. j) concluded by way of a public auction;
  22. k) for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, or services related to leisure, entertainment, sporting, or cultural events, if the Contract specifies the day or period for the provision of the service;
  23. l) where the Consumer has expressly requested the Seller to visit them for the purpose of carrying out urgent repairs or maintenance; if the Seller provides services in addition to those specifically requested by the Consumer, or supplies goods other than the spare parts necessary to carry out the repairs or maintenance, the Consumer has the right of withdrawal with respect to such additional services or goods;
  24. m) for the provision of services for which the Consumer is obliged to pay a price, where the Consumer has expressly requested the Seller to visit them for the purpose of carrying out repairs, and the service has already been fully performed with the Consumer’s express prior consent.
  25. The right to withdraw from a distance contract applies to Consumers and Entrepreneurs with Consumer Rights.
